Officer’s Narrative:

On Monday May 1, 2023 at approximately 11:02pm I, PFC Z Colvin, was traveling southbound on E 2nd Ave when I observed a black 1995 Chevy truck in the outside lane passing through the 300 block up ahead of me. As the vehicle drove southbound on E 2nd Ave it swerved out of its lane 3 times through the 300, 400, and 500 blocks. I then got behind the vehicle and activated my blue lights and we stopped on E 6th Ave, just off of E 2nd Ave.

I then made contact with the driver who was identified as Sigmund White. I told Mr White why I stopped him and asked for his driver’s license. When he went get his license, he first took out a credit card. Also, while he was talking, I noticed the odor of an alcoholic beverage emitting from him and that his speech was slurred.

I asked Mr White to step out of the vehicle and I asked him how much he had to drink. He told me he had two beers and also some other kind of drink. I asked where he got the beer from and he told me the High Tech. I asked if he had been drinking on Broad St at all and he told me he got food there. I told him I had seen his truck on Broad St earlier and I tried to ask where he got the food, but he never gave me a straight answer.

I then asked if he would take a field breath test and he told me he would. I attempted to have him provide a breath sample and he blew air around the outside of the tube. I told him he had to blow air into the tube and the second attempt he did not blow any air into the tube at all. I went to put the alcosensor away and he told me he wanted to do it.

I brought it out and he attempted to provide a 3rd sample. This time he only provided a very small breath sample, but I was able to do a quick pull test which did provide a positive test for alcohol (.277 grams). I then asked Mr White if he would be willing to do field sobriety testing and he told me he would. During this time I also noticed he cotton mouth and a white foamy substance built up around the corners of his mouth.

The first test I had Mr White do was the horizontal gaze nystagmus test. I gave Mr White the instructions and he had an extremely hard time doing the test. He kept not following my finger and other times would move his head. I was able to finish the test and I observed the following 6 clues on the test:

Lack of smooth pursuit in both eyes
Distinct and sustained nystagmus at maximum deviation in both eyes
Onset of nystagmus prior to 45 degrees in both eyes

I did not observe vertical nystagmus. While conducting the test I noticed Mr White’s eyes were bloodshot and watery. I also noticed every time he breathed out, I got a very strong odor of an alcoholic beverage in my face. Lastly, while Mr White was doing the test he was swaying in all directions.

I then tried to have Mr White do the walk and turn. I gave the instructions and he did not remain in the starting position as I had instructed him to. Then when I finished giving the rest of the instructions, I tried to explain to him how to get back into the starting position. Mr White was unable to do so. I explained it and demonstrated it several times and he kept getting his feet crossed up and nearly lost his balance.

At this point I decided trying to do any more testing would be a danger to him and determined he was under the influence of alcohol. I placed him in handcuffs and told him he was under arrest for DUI. I read him Georgia implied consent for suspects age 21 and older. He stated he would take the state blood test. He was placed in the back of my patrol car and his fiance came and picked up the vehicle.

I then transported Mr White to Atrium at Floyd. In the parking lot I let him know the blood test was voluntary and asked if he understood the implied consent card. He told me he did and that he still wanted to take the test. We then went inside and made contact with phlebotomist [REDACTED] who would draw his blood using the GBI blood kit.

[REDACTED] drew the blood, placed it in the vials, sealed the box and handed it back to me to place into evidence at the Rome Police Department. The kit will then be sent to the GBI for testing.

I then transported Mr White to the Floyd County Jail where he was booked in on citations for DUI and failure to maintain lane.
