[NARRATIVE #1 on June 26, 2023]

On June 26th, 2023 I, OFC Boyd, responded to the area of Melody Lane and Brookstone Drive in reference to a subject that was assaulted. Dispatch advised that the subject was intoxicated and could not give his exact location. The subject advised dispatch that the person who assaulted him left in a red Dodge Challenger.

While attempting to locate the victim, I observed a red Dodge challenger traveling South on Melody Lane. I then activated my emergency equipment and initiated a traffic stop on the vehicle. I then explained to the driver (Luis Fernandez) that I stopped him because his vehicle matched the description that the assault victim advised. I then asked him if he was involved in the incident and he stated that he was not.

I then observed dried blood on Fernandez’s left hand. I then asked him to exit the vehicle multiple times. Fernandez continued to look at his phone and did not comply with my requests. I then opened his door and grabbed his left wrist and attempted to escort him from his vehicle. Fernandez then stood up and attempted to pull away from me. PFC Groover then grabbed his other arm as Fernandez continued to resist. I eventually placed Fernandez in handcuffs that were double locked and checked for tightness and advised him that he was detained.

The passenger (Maria Pimentel) was removed from the vehicle by other officers on scene. I witnessed Pimentel attempt to walk away from Officers while they were giving her lawful orders to stay with them. When officers attempted to place her in handcuffs, she continued to pull away and resisted being placed in cuffs.

I then began to speak with Fernandez who stated that he was at his residence with some friends. He then stated that one of his friends, [REDACTED], was intoxicated and was no longer wanted in the residence. Fernandez stated that he asked [REDACTED] multiple times to leave, but he refused. Fernandez stated that [REDACTED] then pulled a knife out and threatened him with it.

Fernandez then stated that he punched [REDACTED] multiple times and kicked him out of the residence. When asked, Fernandez stated that he did not call police because he was a grown man and could handle his own issues. I then asked him why he left the residence after kicking [REDACTED] out, and he stated that he knew the police would be on the way.

While I was speaking with Fernandez, SGT Kasmar was speaking with Pimentel, while in the process, he located a large clear bag containing suspected Methamphetamine in Pimentel’s purse. He also located a small amount of marijuana in the center console of the vehicle. At this point, Pimentel was placed under arrest for Possession of Methamphetamine, Possession of Methamphetamine with intent to distribute, Possession of Marijuana less than an ounce, and two counts of obstruction.

Pimentel was then placed in the back of my marked patrol unit. Pimentel then advised me that she might have more marijuana in her bra. Due to no female officers being on duty I advised her that we would retrieve it once we arrived at the jail. At this time I read Pimentel Miranda and she advised that she understood and would speak with officers.

She was then asked who she received that narcotics from and she would not divulge that information however she did admit that the methamphetamine and the marijuana did belong to her. I then transported Pimentel to the Floyd County Jail where she was booked for the previously mentioned charges.

While in the process of booking Pimentel, a female booking officer searched Pimentel and recovered a small gray bag containing more suspected Methamphetamine from her bra. I then advised Pimentel that she would be charged subsequently with Crossing the Guard-line with drugs. She was then booked with no further incident.

Officers on scene attempted to make contact with [REDACTED], but were unable to locate him. Dispatch also attempted to contact him several times with no answer back. Fernandez was suspected to be under the influence of alcohol. Officers on scene administered a preliminary breath test rendering no presence of alcohol (0.00 BAC). Fernandez was then released from the scene taking all of Pimentel’s possession’s that she wanted him to take possession of.

All found evidence was collected and stored in Rome Police Department evidence lockers.

[NARRATIVE #2 on June 26, 2023]

On Monday, the 26th of June 2023, at approximately 0418hrs, I (SGT Kasmar) was backing up officers on Melody Lane, Rome, Georgia, for a fight call, and a person was injured and bleeding. I was down the road and went to assist in the injured person’s location. I drove through the area and couldn’t locate him.

I heard OFR Boyd out with a red Challenger, which matched the description of the suspect vehicle dispatch gave to us. I walked up to the car with OFR Boyd and noticed that the driver, Luis Fernandez, had fresh blood on his hand. I told him to turn off the car and step out and he complied. Mr Fernandez turned off the car and said he needed to call someone.

OFR Boyd reached in, pulled the knob up to unlock the car, and had the driver get out. He was put into handcuffs and taken to the side. I went over to talk to the passenger side and smelled a burnt odor of marijuana coming from the car. I asked the female, who was later identified as Maria Pimentel (offender), to step out of the vehicle and talk to me.

Ms. Pimentel exited the car and grabbed her bag, and began talking on the phone while walking away. I told her she needed to stop, hang up the phone, and speak to me. She continued to walk away, and I grabbed her arm, escorting her back to the car. I told her to hang up the phone, which she did, and set the bag on the vehicle. I told her how I was getting the odor of marijuana coming off of her also, and she was walking away again when told to stay there.

I grabbed the smaller shoulder bag she had tucked close to her body, and she grabbed it from my hand. I grabbed her wrist, rotating it inwards and straightening her arm, pushing her against the car. Ms. Pimentel continued to move around and angrily shouted at us. I placed her in an armbar and placed her on the rear of the vehicle to control her and she was handcuffed. I began to search her bags, and in the smaller shoulder bag, I found around 22 grams of methamphetamine in a clear plastic baggie. I notified dispatch of the drugs recovered and secured the evidence in my patrol car.

I searched the car and found the source of the marijuana smell being a small piece of marijuana cigarette in the center console. All evidence was placed in the Rome Police Department’s temporary evidence room. Ms. Pimentel was placed under arrest, and Mr. Fernandez (witness) was released.
