On 6 August 2023, I (Officer Metroka) while on duty for the City of Rome Police Department, in uniform, in a marked patrol vehicle, was dispatched to 507 Turner McCall Blvd, Rome GA 30165 in reference to a fight at approximately 10:27 PM.
Upon my arrival, PFC Gilbreath was on scene with one of the males that had been alleged to have been fighting on the property. I then spoke to the male, later identified as David Silvis. Silvis stated that he had asked Mark Davis to charge his “vape” for him. Silvis stated that when he got his vape back, he quickly realized that Davis had swapped the vapes out on him. Silvis stated that when he had confronted Davis about swapping the vapes out on him, Davis then to the back of the vehicle and got a hammer. Silvis then stated that he had then pushed Davis’s car door closed on him.
I then went and spoke to a witness on scene, [WITNESS #1]. [WITNESS #1] advised that she knows Davis and Silvis to be friends. [WITNESS #1] saw the duo “going back and forth” about a vape. [WITNESS #1] stated that she had seen Davis digging around in his car like he was looking for a weapon. [WITNESS #1] stated that she then saw Silvis push the car door closed against Davis.
At this time, PFC Gilbreath came up to me and advised that she had spoken to Davis and he advised that he did grab a hammer. Davis also denied having stolen Silvis’s vape or having swapped it out. Due to the men having
