[NARRATIVE #1 on May 12, 2024]

On 05-12-2024 at 1548 pm, I responded to the listed incident location in reference to a disturbance. Due to the poor condition of the driveway I met the male victim at the Innovative Laser to get a statement.

The victim stated he had brought the female victim (mother) to the incident location, which is where she lives. The male victim stated she had decided to stay with him at his residence because the suspect (other son) had just released from prison on Monday and was acting very erratic and is known to be dangerous.

The male victim stated the female victim got out of the listed truck and went inside of the residence to get clothes to continue staying at his residence. The male victim stated he then heard the female victim hollering for the suspect not to put his hands on her again.

The male victim stated he got out of the vehicle and walked to the residence where he was met by the suspect at the front door. The male victim stated after a brief argument, the suspect headbutted him in the face. The male victim stated he then pushed the suspect backwards away from him, causing him to fall from the front porch.

The male victim stated the suspect then ran towards the listed vehicle that was still running. He stated both juvenile victims were in the back seat. The male victim stated the suspect then entered the vehicle and began backing down the driveway then stopped and began driving back towards the residence where he drove around the yard and then on a very steep embankment where he stated the truck nearly flipped over.

The male victim stated the suspect then parked the vehicle and exited without further incident. He stated him and the female victim then got into the vehicle and left the property. I observed the male juvenile to be visibly scared from the incident. Both were restrained in the vehicle and uninjured. The male victim stated he did not give the suspect permission to take the vehicle and would never allow the juveniles to be left in the suspect’s care due to his long history of violence and drug use.

At this time I made contact with the suspect at the residence. I observed him to be lying face down with his legs and feet inverted, plank position, on the couch. He had a black brace and duct tape wrapped around his lower back. He stated his back hurt but was ok.

I then detained him by hand cuffing him from the back, double locking, and checking for fit. The suspect was talking “out of his mind” but stated he was not on any drugs. He was then placed under arrest for the listed charges and was transported to the Walker County Jail by Deputy Brewer. The victims were provided with a copy of the case number for a report.

[NARRATIVE #2 on May 12, 2024]

I spoke with the male juvenile briefly in the back of the truck he was riding in, he was strapped in his car seat. I asked him if he could tell me his name. He told me his first and last name and spelled them both correctly. He said he was five years old and his birth day was in October but he did not know the date.

I could visibly see he was shaking and had been crying, he was also hard to understand at first as he was still upset. I asked him to tell me what happened and he said his uncle/suspect got in the truck and took off. He made a motion that they had either jumped over or off of something and it scared him. He said his one-year-old sister was in the other car seat and she was in the truck also.

I saw a partially empty Dr. Pepper bottle in the floor board and asked him if it was full. He said it half full and indicated with his hand by holding it to the level of the liquid it was almost empty. It appeared to have approximately one or two mouthfuls left in the bottom of the bottle.

I accompanied Sgt. Reece and Deputy Scarborough to the incident location. We were not able to drive up the driveway and had to park our patrol vehicles. We walked to the residence and located the suspect.

As we approached the front door the suspect had his ankles up on the back of the couch and he was lying face down. When he asked what he was doing he said his back hurting and he was stretching it out. I would describe him as being in a downward plank position. Deputy Scarbrough handcuffed him and we escorted him to my patrol unit.

He was placed in the back of my patrol unit and I transported him to the jail without incident. The back seat of my patrol unit was checked for contraband before and after transport. No items of contraband were located.

This incident is cleared by arrest at this time.
