Officer’s Narrative:

On October 16, 2023, at approximately 0010 hrs, I Deputy Patlan conducted stationary speed detection on Hwy 178 near Ben Roy Mcclendon Road. I observed a black charger heading southbound on Hwy 280. I used my front mounted RADAR (S/N: DE20813) to clock the vehicle going 68 mph.

When the vehicle passed my location it continued south bound at which point I activated the rear mounted RADAR (S/N: DE20364). The vehicle then began accelerating reaching 86 mph in a 55 mph zone. I left my stationary position and followed behind the vehicle in attempt to catch up to it and conduct a traffic stop.

I was able to catch up to the vehicle and initiated my blue lights to conduct a traffic stop on Hwy 178 near Rodney Stanley Road. I walked up to the drivers side window and asked the male driver for his license and asked him why he sped up even after seeing me sitting on the shoulder of the road near the roadway. The driver denied the fact that he was speeding and explained he was trying to take his brother home.

While talking to the driver, identified as TYLER SMITH I detected an odor of marijuana emitting from inside the vehicle. I asked the driver about the smell and the front male passenger who accompanied SMITH said he had just smoked prior to getting into his brothers car. I then instructed the driver to step out of vehicle and radioed for Sgt. Powell to assist me on this stop.

I had the driver sit on the front bumper of my patrol car and instructed the passenger to come out and sit on the back bumper of his brothers vehicle while I waited for back up. While I waited for Sgt. Powell I asked the driver again why did he speed off the way he did at which point his brother told him to just admit what he did. TYLER then admitted to me that he sped his vehicle up the speed I clocked him at.

A short time later Sgt. Powell arrived and stayed with the two subjects while I began a search of the car. I began my search in the driver’s seat and worked my way to the back seats. There I located a gray in color book bag with a bulge sticking out of the front pocket. I felt this area with my hand and it sounded like a plastic bag rustling.

When I brought the bag closer to me the odor of marijuana got stronger. I opened the front pocket and located a zip lock bag with an amount of a green leafy substance inside believed to be marijuana. I held the gray book bag out the car and asked the two subjects who did the book bag belong to. The passenger, later identified as MICHALE JONES said that the gray book bag belonged to him.

Also in the back seat area were two additional bags. One being a red duffel and one a green in color book bag. I asked the two subjects again who the other bags belong to. MICHALE said the the bags belong to him. TYLER stated that the cloths that were scattered across the back seat were the items belonging to him.

I then opened open the red duffel and located a white container labeled “Espir Plant Protein Powder”. I opened this container and located two additional baggies each containing an amount of the same leafy green substance inside. Underneath the baggies were more empty smaller bags commonly used for packaging. The third book bag had only work gloves and clothing.
