Walton County (March 12, 2023) – Authorities received a call about a rape that had just occurred at a Davis Street home, with the suspect still inside the house. The 15-year-old victim told the Monroe Police Department officers she was spending the night at her friend’s house and had woken up to a man raping her.
She said she awoke to the suspect, Kevin D. Smith, “putting his penis inside her, and it hurting.” Crying, she fled to the bathroom and texted her friend, who was in another area of the house, to collect and console her.
She feared Smith but did not want him to leave the home before getting caught. They said they were unsure how he had entered the house because the doors were locked when they went to bed that night.
Officers entered the house and found Smith lying in a bed in a back bedroom. They handcuffed him and placed him in a patrol vehicle.
The officers collected the victim’s clothing, the bed sheets, and Smith’s cell phone, which they discovered charging in the kitchen.
They drove Smith to the Walton County Jail without incident and entered the clothing he wore during the assault into evidence. He was charged with child molestation and statutory rape. This case is currently pending in court.

[NARRATIVE #1 on March 12, 2023]
On March 12, 2023 I, Ofc. Caldwell 1346, responded to a report of rape at [700 BLOCK] Davis Street in Monroe, Georgia. Prior to officers arrival dispatch advised that the caller stated she woke up to someone raping her and the male was still in the room.
Upon officers arrival, two female subjects were standing outside and pointed officers to [700 BLOCK] Davis Street, apartment [REDACTED]. Officers did a sweep of the apartment, to look for the male suspect that was reported to still be in the residence. In one of the bedrooms a male was laying down in the bed.
The male was told to stand up and was handcuffed behind his back, the handcuffs were double locked and checked for fit. The suspect, Kevin Smith, was told he was being detained and was searched incident to arrest. Kevin was then placed into the back seat of my patrol vehicle. No other persons were found inside the residence.
I then went back inside to talk to the two females that had been in the house. I spoke to the victim, [REDACTED BY AGENCY], who reported being woken up to Kevin putting his pen*s inside her and it hurting. I did not ask any more about the rape but did ask [REDACTED BY AGENCY] what happened afterwards to establish a timeline.
[REDACTED BY AGENCY] stated that after it happened, she went into the bathroom because she was scared of Kevin and didn’t want him to leave before being caught. [REDACTED BY AGENCY] is 15 years old and does not live on location, but had spent the night with her friend, [REDACTED].
She then texted the other occupant of the house, [REDACTED], to come get her from the bathroom. [REDACTED] collected [REDACTED BY AGENCY] who was crying. [REDACTED] stated she called 911 and officers arrived a short time later, [REDACTED BY AGENCY] stated that she went to bed around 0100 hours and the house had been locked, she was unsure how Kevin got in.
Kevin was taken to Monroe Police Department to be interviewed. [REDACTED BY AGENCY] and [REDACTED] were given a courtesy ride to Monroe Police Department, so they could be interviewed by CID and give recorded statements. Prior to [REDACTED BY AGENCY] leaving, she changed into clean clothes and the clothes she had been wearing during the rape, were placed into a paper evidence bag.
I stood by at the residence and secured it until Det Xiong #367 arrived. Upon Det. Xiong’s arrival, he took over the crime scene log that had been started and collected bed sheets and clothing, where Kevin had been sleeping and [REDACTED BY AGENCY] stated the rape occurred.
There was also a black cell phone charging in the kitchen, that Kevin had asked officers to grab because it was his. Det. Xiong collected all the evidence and the residence was secured. A short time later I was at the Police Department and stood by while CID obtained swabs from Kevin.
I then fingerprinted Kevin for the charge of Rape and Child Molestation. Kevin was then transported to Walton County Jail and turned over to jail staff without incident. The clothes Kevin had been wearing during the incident were collected and turned into evidence.

[NARRATIVE #2 on March 12, 2023]
On Sunday, March 12, 2023 at 0634 hours, I responded to [700 BLOCK] Davis Street in reference to a rape case and the suspect was still in the residence. Upon my arrival, one of the females told us the suspect was in the bedroom. Cpl Rutledge started clearing one of the bedrooms when the other officers located the suspect in another bedroom.
The suspect was placed in handcuffs and put in a patrol car. I started the crime scene log and then gave it to Officer Caldwell when I left the scene.

[NARRATIVE #3 on March 12, 2023]
At the above date and time, I Ofc. Jones responded to the incident location in reference to a rape. When I arrived on scene at [700 BLOCK] Davis St I entered the house and walked to the back room with my service weapon drawn to attempt to locate the rape suspect.
Contact was made with the suspect in the back bedroom and he was taken into custody by Ofc. Potts and Ofc. Caldwell. I assisted in clearing the rest of the residence and held the crime scene until I transported the victim and her friend to the police department to be interviewed.
