WILLFUL OBSTRUCTION OF LAW ENFORCEMENT OFFICERS

On 3/21/2024 at 0332hrs, I Deputy Sheriff Henderson responded to 745 Poplar Rd in reference to Disorderly conduct.

Upon arrival I observed The Captain of Hospital speaking with Evan Estela. Evan was upset and yelling while the Captain was speaking to him calmly. When Evan was asked a question, he would point towards the security guards standing approx 20ft away and refer to them as idiots, while raising his voice even more. This incident was occurring in the parking lot of the emergency room while patients were walking out. Evan was then asked to calm down due to how loud he was being but he was uncooperative.

I then went into the hospital to speak with Nurse [VICTIM #1]. She advised that Evan began requesting his discharge paperwork from her and she told him that she would inform the Doctor because he would have to fill the paperwork out. [VICTIM #1] advised that Evan continued to ask so she told Evan he was free to leave at anytime and he didn’t have to wait on discharge paperwork. [VICTIM #1] advised that Evan became irate and began cussing her out and calling her a “Bi*ch”. [VICTIM #1] advised that she then called Security.

I then spoke with [WITNESS #1], who was one of the security officers involved in the incident. [WITNESS #1] advised that he, [VICTIM #2], and [WITNESS #2] then escorted Evan outside. He advised that Evan lunged at [VICTIM #2] and the three then took Evan to the ground.

I then watched surveillance footage from the incident. The video showed all the parties including Evan’s mother ([REDACTED]) walk outside. Evan then stopped just outside the exit door and began arguing with security. Evan can be scene holding his wrist band up in [VICTIM #2]’s face. [REDACTED] can then be seen stepping between Evan and security, putting her arm around Evan and trying to get him to go to the car. Evan can then be seen pushing [REDACTED]’s arm off of him and lunging at [VICTIM #2]. [VICTIM #2], [WITNESS #2], and [WITNESS #1] then took Evan to the ground.

I then went back outside and gathered everyone’s information. I then spoke to Evan and advised him that he was Criminally trespassed from the hospital unless he is there for medical attention. I then advised Evan “You’re under arrest, turn around and put your hands behind your back”. Evan then asked “Why” and tensed his body up. Evan then stated “I’m not resisting” but refused to put his hands behind his back. Deputy Sheriff Todd, Wood, myself and two Newnan Police Department Officers had to force Evan’s arms behind his back. Once Evan was handcuffed, Deputy Sheriff Todd and Wood began escorting him to my patrol car. Evan attempted to stop walking, and fall to the ground twice.

Once at my partol car, I opened the door and inform Evan to get into the car. Evan then put his foot on the side skirt of my car and began pushing back. I then told Evan approximately 5 more times to get into the car or he would be tased. Evan was still resisting so I delivered one short drive stun to his stomach. Evan then still refused to comply and get into the car so I went around to the other side and pulled him in by his hancuffs. Evan was then transported to the Coweta County Jail and turned over to Jail staff. He will be charged with Disorderly conduct and obstruction.
