On 6/25/2023, at approximately 2256 hours, I, Ofc. Massey, was stationary on Old Town Road, near Rockmart Road, observing traffic. As I was stationary, I observed a silver 2001 BMW 330CI (GA tag: [REDACTED BY AGENCY], VIN: [REDACTED BY AGENCY]) approach my location traveling westbound on Old Town Road.
I observed the BMW to accelerate rapidly. I heard the engine of the BMW rev to a high RPM. As the BMW came closer to my patrol vehicle, I observed the BMW lower its rate of speed. The BMW passed in front of my patrol vehicle. As it did so, I observed the driver side window to have window tint which I suspected to be darker than the legal limit.
I positioned my patrol vehicle behind the BMW and initiated a traffic stop on the BMW by activating my emergency lights, in-turn activating my in-car camera system. The BMW continued traveling on Old Town road at a slow
