At about 5:50PM on this date, I was dispatched to the incident location concerning a physical domestic dispute.

When I arrived at the Trailer Park, the victim was waiting for me at the entrance on foot. She appeared upset/emotional. I was aware that she had been living in the same home with Mr. Lane for at least several months, but I didn’t know if it was just a roommate or if it was as a paramour. She said that on this date, he got home from work and then got irate over his bedroom door having been closed up with his sick dog in the room and also about him not being able to find a clean towel after he recently bought a bunch.

She said that he went to look in her room for towels and she was walking in behind him with a bowl of cereal in her hand, then he suddenly grabbed her by her neck with one of his hands and shoved her down, then when she started get up from the hallway floor, he pushed her back down again hard. She pointed out wet spots on her clothing that she said was from the milk spilling on her. She said that she dropped the ceramic bowl and when she fell the second time, she landed on it with her weight such that it hurt her right leg.

I carried her back to the scene, as Sgt. Bennett was pulling up behind me. We went in the front door, where I saw [WITNESS #1] on the living room sofa. The victim said that the boy had seen the assault. I called for Mr. Lane to come out to talk to me, which he did. I had him to wait on the front porch. The victim pointed out the spilled cereal and milk residue on the floor in the hallway, which I photographed.

She pointed out a red mark under her right jawbone on her neck where she said that he grabbed her. She claimed that he tossed at wooden shoe rack at her when she was down on the floor. She pulled up her shirt to where I could see a red mark on her upper back. The mark was kind of narrow and straight, which did look like it would match the wooden shoe rack that I saw at the back door in the hallway.

I spoke to Ms. [WITNESS #2], who had came out from the back when Mr. Lane came out. Ms. [WITNESS #2] agreed with the account that the victim gave. [WITNESS #2] said that she witnessed the whole assault, and that she had tried to block the view so that [WITNESS #1] wouldn’t see it from his seat on the living room sofa.

I spoke to Mr. Lane. He agreed that he came home and got irate about the issues of his bedroom door and the missing towells. He said that he started to go in to the victim’s bedroom and that she was right behind him “running her mouth”. Mr. Lane admitted that he “just snapped” and grabbed her and pushed her down.

Mr. Lane did have a visible scratch on the left side of his neck. He claimed that she did that to him.

Sgt. Bennett and I asked the victim about that. She said that when he came at her the second time to shove her back down, that she held her right hand out to try to keep him at bay because he is bigger and stronger than her, that she didn’t mean to scratch him, but it is possible that her fingernail did when he came towards her.

The victim said two or three times that she wanted the offender arrested. I told the offender that he was under arrest.

He was taken to our jail, where I issued him a citation for disorderly conduct. He was warned that he could be charged for simple battery family violence and possibly some variation of cruelty to children.

Mr. Lane expressed that he would be seeking an eviction on the victim. The victim was informed about her options, such as the womens shelter or application for a TPO.
