On 01/29/2024, I responded “Code 1” to [1500 BLOCK] Doster Road in Winder, Georgia in reference to a domestic disturbance call. (Please reference Case 2024-00006049)

Upon arriving on scene, Deputy Friel and I met with a male later identified as Michael Giordano. Mr. Giordano appeared very intoxicated and was disorderly while the investigation was being conducted. On numerous occasions, Mr. Giordano approached Deputy Friel and I in an aggressive manner. Mr. Giordano was instructed multiple times to calm his demeanor.

While on scene, Mr. Giordano advised numerous times for Deputy Friel and I to leave the scene. He was advised we could not do so until we concluded our investigation. Barrow County Dispatch informed me on scene Mr. Giordano was calling 911 while deputies were on scene and yelling and cursing at the call taker. Mr. Giordano was extremely rude and vulgar towards the call taker, calling names saying “yall motherfu*kers” and advising them to make law enforcement leave or else he would make them leave.

Dispatch was able to determine Mr. Giordano called 911 while I was on scene at the following times. 2304HRS, 2306HRS, 2317HRS, 2348HRS, 2357HRS, 2358HRS, 0040HRS, 0042HRS, and 0052HRS. Mr. Giordano also called Georgia State Police and demanded they make law enforcement leave his residence. Mr. Giordano was advised numerous times to allow myself and Deputy Friel conclude our investigation, however he continued to call 911 and continue to scream and curse at the call taker.

Due to his actions, I advised Mr. Giordano he was under arrest for Unlawful Conduct during 911 call and placed him in handcuffs. (checked for fit, double locked, and searched incident to arrest.) I transported Mr. Giordano to the Barrow County Jail and released him to the deputies/staff on duty.

I contacted the oncall magistrate judge and obtained warrant 2024-0453MW for Unlawful Conduct during 911 call; OCGA 16-11-39.
